Welcome to Lav Vintage (“Lav Vintage,” “Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, online store, products, services, and any transactions conducted through our website (collectively, the “Services”).

By accessing the website, browsing, placing an order, or purchasing any product from Lav Vintage, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use the Services.

1. Eligibility & Use of Website

You must be at least 18 years old or the age of majority in your jurisdiction to use this website or place an order. You agree to use the Services only for lawful purposes and in accordance with all applicable laws and regulations.

You may not use the Services to engage in fraud, misrepresentation, abuse, harassment, interference with site functionality, attempts to gain unauthorized access, or any activity that could damage Lav Vintage, its reputation, or its customers.

Lav Vintage reserves the right to refuse service, cancel orders, restrict access to the website, or take appropriate action at its sole discretion.

2. Products, Descriptions & Made-to-Order Nature

All Lav Vintage products are made to order. Production begins shortly after an order is placed. While we strive to display product descriptions, images, colors, and details as accurately as possible, variations may occur due to screen settings, lighting conditions, or the handmade nature of our products.

Product images are for illustrative purposes only and may not represent exact scale or final appearance.

Once an order is placed, it cannot be canceled, modified, or changed for any reason, including changes to size, shipping address, design elements, or product selection. Customers are solely responsible for reviewing all order details prior to completing checkout.

3. Handmade Nature of Products

Lav Vintage jewelry is handcrafted. Slight differences in texture, color, shape, finish, resin placement, or overall appearance may occur. These variations are inherent to handmade items and are not considered defects.

By purchasing from Lav Vintage, you acknowledge and accept the handmade nature of our products.

4. Pricing, Taxes & Payments

All prices are listed in U.S. dollars unless otherwise stated. Prices, promotions, and product offerings may change at any time without notice. Applicable taxes and shipping fees are calculated at checkout.

Payment must be received in full before production or shipment begins.

5. Shipping, Delivery & Risk of Loss

Processing and shipping timelines provided on the website or at checkout are estimates and not guaranteed. Delays may occur due to production volume, carrier issues, weather, or circumstances beyond our control.

Once an order has shipped, Lav Vintage is not responsible for delays, misdeliveries, or packages marked as delivered but not received. Risk of loss transfers to the customer upon carrier delivery confirmation. Customers are responsible for providing accurate shipping information.

6. Refunds, Returns & Exchanges

All sales are final. Due to the made-to-order nature of our products, Lav Vintage does not accept cancellations, returns, or exchanges under any circumstances, including sizing issues, preference changes, dissatisfaction, or buyer’s remorse.

7. Materials Disclosure, Allergies & Assumption of Risk

Lav Vintage jewelry is created using materials that may include stainless steel, gold-plated components, and UV resin. We do not guarantee that our products are hypoallergenic or suitable for individuals with metal sensitivities, resin sensitivities, or allergies.

By purchasing and wearing our products, you voluntarily assume all risks related to allergic reactions, skin irritation, discoloration, sensitivity, discomfort, or other adverse reactions. Lav Vintage shall not be held liable for any such reactions.

8. Damaged or Incorrect Items

If your item arrives damaged or incorrect, you must contact Lav Vintage within 72 hours (3 days) of confirmed delivery.

You must provide clear photographic evidence of:

The item from multiple angles
The packaging
The shipping label

Claims submitted after 72 hours of confirmed delivery may not be eligible for replacement.

If a manufacturing defect is verified, Lav Vintage may offer a replacement or repair at its sole discretion. Refunds are not guaranteed.

Damage caused by water exposure, chemicals, impact, improper handling, or normal wear and tear is not considered a manufacturing defect and will not qualify for replacement.

If a replacement is approved, the original item must be returned before a new item is shipped. Return tracking must show movement prior to processing the replacement.

Lav Vintage reserves the right to deny claims that do not meet the above requirements.

9. Seller Discretion & Order Refusal

Lav Vintage reserves the right, at its sole discretion, to refuse, cancel, or refund any order at any time and for any reason, including but not limited to suspected fraud, pricing errors, inventory limitations, policy violations, misuse of promotions, abusive or inappropriate behavior, or operational concerns.

Any refunded amounts will be returned to the original form of payment, and Lav Vintage shall have no further obligation to fulfill the order.

10. Chargebacks & Payment Disputes

Customers agree to contact Lav Vintage prior to initiating a chargeback or payment dispute. Chargebacks initiated without first contacting Lav Vintage may be disputed using these Terms, order records, production documentation, and shipping confirmation.

11. Intellectual Property

All content associated with Lav Vintage, including but not limited to product designs, jewelry concepts, artwork, images, photographs, text, logos, branding, product descriptions, packaging, marketing materials, and website content, is the exclusive intellectual property of Lav Vintage or its licensors.

Ownership of a physical product does not grant any rights to reproduce, distribute, copy, modify, or commercially exploit any Lav Vintage intellectual property. Unauthorized use, reproduction, or distribution is strictly prohibited.

12. Unauthorized Resale

Products purchased from Lav Vintage are intended for personal use only.

Unauthorized resale, reproduction, distribution, or commercial exploitation of Lav Vintage products—whether online or offline—is strictly prohibited without prior written consent from Lav Vintage.

Lav Vintage reserves the right to refuse service, cancel orders, terminate accounts, and pursue legal remedies, including cease and desist notices, against any individual or entity found to be reselling Lav Vintage products without authorization.

13. Prohibited Uses

You may not resell Lav Vintage products for commercial purposes without authorization, use Lav Vintage branding, logos, images, or product descriptions in resale listings, misrepresent affiliation with Lav Vintage, or copy or reproduce Lav Vintage content for commercial gain.

Customers are free to share honest opinions and personal experiences. However, you agree not to make false, misleading, or defamatory statements about Lav Vintage, its products, or its representatives, including knowingly false claims presented as fact or statements made with reckless disregard for the truth.

Any such actions constitute a violation of these Terms.

14. Artist & Cultural Reference Disclaimer (Non-Affiliation)

Lav Vintage creates original jewelry inspired by music, art, and culture. Lav Vintage is not affiliated with, endorsed by, sponsored by, or officially connected to any artist, estate, label, publisher, or rights holder.

Artist references are used solely for descriptive or tribute purposes. All trademarks remain the property of their respective owners.

15. Termination & Enforcement

Lav Vintage reserves the right to terminate access to the Services, cancel orders, refuse future service, and take legal action for any violation of these Terms.

Enforcement actions may include cease and desist notices, intellectual property claims, platform takedown requests, or other remedies permitted by law.

16. Limitation of Liability

To the fullest extent permitted by law, Lav Vintage shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our website, products, or Services.

17. Indemnification

You agree to indemnify and hold harmless Lav Vintage from any claims, damages, liabilities, losses, or expenses arising from your violation of these Terms or misuse of the Services.

18. Governing Law

These Terms are governed by the laws of the state in which Lav Vintage’s operating business is registered, without regard to conflict of law principles.
